After a year of delays while the Zoning Board of Appeals struggled to find enough members without conflicts of interest, the contested case hearing that will decide whether Kyo-ya can build its 30-story tower on Waikiki Beach.

Here’s the agenda for the meeting, which started at 12:30 p.m.

The board just listened to arguments from both sides on the developer’s motion to dismiss the appeal. Kyo-ya attorney Barry Sullivan says opponents don’t have standing and didn’t raise the right objections about the hotel’s variance from the Department of Planning and Permitting.

Linda Paul, representing the opponents, said Kyo-ya should have hashed out the 1965 beach agreement with the state government, which reneged on the deal. She said Planning Director David Tanoue erred when he determined that the beach agreement should count toward the height limit in the variance.
