Nestor Garcia is abandoning his proposed fee on single-use paper checkout bags, at least for today, saying an opinion from city lawyers yesterday raised serious questions about the legality of such a proposal.

Ernie Martin amended the bill so that, if passed, it would create a full ban on plastic bags starting in 2015. That amended version is now being discussed.

Garcia said he’ll vote against Martin’s version because he wants more discussion about a fee. Other members are weighing in now.
