Hawaii State Attorney General David Louie has told the Gov. Neil Abercrombie that his appointment of Peter Cahill as circuit court judge on Maui is void — he’s two days late.

Louie said in a statement:

“The appointment of a judge has to be made within 30 days of the Judicial Selection Commission forwarding the list of applicants to the Governor. In this case the Judicial Selection Commission sent the list to the Governor on May 11th.  Therefore the Governor had to make an appointment by June 10th.” 

According to the state constitution, the Judicial Selection Commission will now make the appointment, with the consent of the Senate. Wonder if they’ll still pick Cahill?

Cahill is a partner in his own firm, Cahill & O’Neill, and has successfully tried and settled injury and wrongful death cases in Hawaii, according to the governor’s office. Cahill, who is 55, earned bachelor’s degree at Seton Hall University and his J.D. from Notre Dame Law School. He is licensed to practice law in Hawai’i, New York, and New Jersey.
